Surrogacy – whether traditional or gestational – evokes a multitude of legal questions as well as sensitive ethical issues. Particularly pressing are the cases where the refusal to recognize the intended parents leads to a legal vacuum. Article 8 (right to respect for private and family life) of the European Convention on Human Rights is usually the point of reference in these cases, both for the child and the intended parents. Typically, the best interest of the child and a margin of appreciation of the states are core issues. There are quite a number of judgements and decisions of the Court as well as a first advisory opinion of the ECtHR regarding this nexus.

Prof. Dr. Ivana Jelić, Judge at the European Court of Human Rights, will discuss questions of legal motherhood in surrogacy cases.

Prof. Dr. Thilo Rensmann, LL.M. (Virginia), University of Augsburg, will give an insight into the German Perspective on Motherhood, Family and the European Convention on Human Rights.

Dr. Stefan Lorenzmeier, LL.M. (Leiden), University of Augsburg, will assume the position of the chair.
