Die Forschungsstelle für anglo-amerikanisches Recht AREA (Augsburg Research Centre of European and Anglo-American Law) unter der Leitung von Professor Dr. Thomas M.J. Möllers ist ein Zentrum für die Zusammenarbeit von Wissenschaftlern aus Deutschland und dem anglo-amerikanischen Raum im juristischen Kontext.
So ist im Bereich der Rechtsdurchsetzung vor allem das US-amerikanische Recht dem deutschen oder nationalen Recht voraus. Stichwörter wie "punitive damages" und "deep pocket doctrine" sind im US-amerikanischen Rechtssystem Alltag und gewährleisten, dass das gesetzte Recht beachtet wird.
Forschung
Der aktuelle VW-Skandal zeigt deutlich, wie verwoben unsere Märkte sind. Die Globalisierung stellt die Herausforderung an die juristische Wissenschaft, dass trotz teilweise erheblicher Unterschiede in den verschiedenen Rechtssystemen darauf zu achten ist, dass Kunden ein und desselben Unternehmens nicht dadurch benachteiligt werden, dass sie einer anderen Rechtsordnung unterliegen, die weniger effektive Rechtsdurchsetzungsmechanismen zur Verfügung stellt.
Gastprofessoren
Die Forschungsstelle ist stolz auf ihre Zusammenarbeit mit zahlreichen Gastprofessoren aus dem anglo-amerikanischen Raum. Hier finden sie eine Auflistung der verschiedenen Professoren und Universitäten, mit denen seit Jahren ein reger Kontakt gepflegt wird.

New publication: Möllers, Auditors report and the German Capital Markets Model Case Act (KapMuG) - legal consequences for EY in the Wirecard scandal

In Volume 19 of the Capital Markets Law Journal (CMLJ) Professor Möllers' article "Auditors report and the German Capital Markets Model Case Act (KapMuG) - legal consequences for EY in the Wirecard scandal" deals with the accounting fraud and ensuing insolvency of Wirecard which have had an enormous impact. Claims from aggrieved investors are now before the courts. As the listed company is insolvent, many claims have instead been lodged against its auditors, EY. Within this framework, the cases should be joined together where possible. Several Regional Courts have rejected the material scope of application of the Capital Markets Model Case Act (KapMuG), but the Third Chamber of the Regional Court of Munich I (LG) has opened proceedings under the Act. This requires the auditors report on the company's annual financial statements to qualify as “public capital market information” pursuant to Section 1(2) of the Act. Because the issue has not yet been discussed, arguments created by legal reasoning must be used to clarify whether claims for damages against the auditors report can be made the establishment objective of proceedings under the Act.
MIPLC-Abschlussfeier 2023

Am Freitag, den 17. November, erhielten die Absolventinnen und Absolventen des Jahrgangs 2022/2023 des Munich Intellectual Property Law Center (MIPLC) ihren Master of Laws (LL.M.) im Rahmen der inzwischen 20. Abschlussfeier.
Gleichzeitig wurde dem langjährigen MIPLC-Vorstandsmitglied, Herrn Professor Dr. h.c. Robert F. Brauneis, die Ehrendoktorwürde der Universität Augsburg verliehen. (...)
Gastvortrag „Gazing into World Society: A System-Based Approach to Global Governance“

In Kooperation mit der DAJV in Augsburg hielt Professor Sungjoon Cho am 7. November um 19:00 Uhr einen englischsprachigen Vortrag zum Thema „Gazing into World Society: A System-Based Approach to Global Governance“. Der Vortrag behandelte die Anwendung der Systemtheorie Niklas Luhmanns auf aktuelle globale Entwicklungen wie wirtschaftliche Entkopplungen und Wirtschaftssanktionen und wurde kommentiert von Dr. Cayle Lupton (University of Johannesburg). Im Anschluss fand eine Diskussionsrunde statt.
Sungjoon Cho ist seit 2003 Professor am Chicago-Kent College of Law (Illinois Institute of Technology) und verhandelte als Vertreter der Regierung der Republik Korea bereits vor der Welthandelsorganisation WTO und der Organisation für wirtschaftliche Zusammenarbeit und Entwicklung OECD.

The Augsburg Summer Program on European and International Economic Law takes place from June 10 to July 19, 2024.
Nowadays, large companies operate on a global scale and must comply with the respective national legal systems. Therefore, basic knowledge is essential in the field of European data protection law, antitrust law, intellectual property law, as well as corporate and capital markets law.
The University of Augsburg offers the Augsburg Summer Program to international foreign students to join German practicing lawyers and German postgraduate law students for a unique studying experience for a six-week intensive course.
The intention of this Program is to impart knowledge in the basic framework of transnational Economic Law through lectures and examination courses in order to meet the increasing requirements of companies and law firms in this field. All of the lectures and talks will be offered in English. After the successful completion of the program, you will receive a formal certificate.
